Definitions
"the Contract" - this booking confirmation
"the Client" - the client named overleaf
"the Artiste" - the artiste named overleaf
"the Engagement" - the performance engagement detailed overleaf
Cancellation
1. Should the Contract need to be cancelled by the Client, the deposit is non refundable and the following conditions apply:
(a) written notification must be received at least 56 days prior to the performance and 15% of the fee to be paid, or
(b) written notification must be received at least 28 days prior to the performance and 50% of the fee to be paid, or
(c) written notification received less than 28 days prior to the performance incurs 100% of the fee to be paid.
Failure To Perform
1. The Client shall not be required to pay the Artiste for any engagement where the Artiste is unable to perform by reason of any cause beyond the Client's control such as National Mourning, War, Fire, Acts of Terrorism, Strikes or Lock-Outs directly affecting the venue, or the by Order of the Licensing or any Public Authority having jurisdiction. In any such event, notice must be given to the Artiste immediately, failing which the Client must pay reasonable expenses.
2. In the event of the Artiste's illness the following provisions shall prevail. The word "illness" shall mean and include any bodily or mental infirmity. If the Artiste is unable to perform through illness, the Artiste shall send a medical certificate to the client within 7 days setting forth the nature of the illness.
3. In the event of mechanical breakdown or accident, the artiste will make every effort to find a way to get around the problem however if the artiste is then unable to perform they shall send a copy of a garage note, a vehicle tow receipt or doctor / hospital letter which ever is relevant to the client within 7 days.
NB The Artiste has never had to cancel a performance yet in the 8 years we have been established as we have a number of professional depping singers/ musicians who work with us and can be called on at short notice to cover for such eventualities.
Terms of Engagement
1. The Contract is subject to the terms of engagement detailed overleaf, including any additional clauses.
2. The Artiste offers an assurance that they and all supporting Artistes, technical crew and other associates, will conduct themselves in a responsible and professional manner at all times, with due regard to venue rules and regulations.
3. The artiste reserves the right to vary the line up from the publicity materials ( eg website / posters etc) on occasion to cover illness / holidays/ personnel changes etc, but will ensure that all singers and musicians substituted are of the same professional standard of ability as those shown on the marketing materials
4. If the performance time is delayed by the client on the night leading to a finish time more than one hour later than the contracted time, each additional hour shall be chargeable at £100 extra from the contracted fee.
Artiste Provisions
1. The Client is to provide a suitable performing area. A stage is not essential but can improve the projection of the show in the increased visibility to the audience. If hiring a stage we would request a minimum of 4m x 2m
2.The Client must ensure there are 2 separate plug points meeting or exceeding British Standards within five metres of the performance area. If insufficient electricity sockets / supply is available and the electrics trip as a result then the artiste is still entitled to full payment even if they have not been able to perform.
3. Due to the nature of the act including costumes, the hirer must provide suitable dressing room / green room facilities ( for band to wait in before the show) , toilets are not acceptable.
4. The Client is responsible for providing adequate supervision and/or security at all times. In the event of unruly or threatening behaviour from any individual, the Artiste is entitled to cease the performance and still be paid in full.
5. Where a DJ has also been hired for an event, the client is to ensure that should the DJ arrive before the band, that they leave sufficient room for the band to set up ( approx 4m wide x 2m deep area minimum or alternatively 3m x 3m)
6. A hot meal for each band member and soft drinks must be provided by the client at least an hour before the artiste is due on stage or preferably earlier.
7. For any outdoor gigs, the performing area must be watertight in the event of a downpour bearing in mind rain does blow in at an angle and there is a lot of electrical equipment involved. We are not able to perform on grass – matting or hard flooring is required. In the event of us arriving at a venue to find the performing area is not watertight either another more suitable performing area must be provided or the performance will not be able to go ahead but the band must be paid in full.
